That would be like drafting legislation which would immunize drunk drivers from any subsequent prosecution for the consequences of their indiscretions (vehicular manslaughter, civil liability, etc.) so long as the person they ran over had a history of J-walking if they were a pedestrian or a history of moving violations if they were in a vehicle. It shifts the burden of proof from the prosecutor and the moving party to the defendant so that guilt is simply inferred from circumstances without having to prove it in accordance with the rules of evidence and criminal procedure.
